HorsePal is a digital horse management platform designed to help horse owners, riders, carers, and other users organise and manage information relating to their horses.

HorsePal is an organisational and record-keeping tool. It is not a veterinary, medical, diagnostic or emergency service.

You must be legally capable of entering into an agreement to use HorsePal.

If you are under the age required to enter into a legally binding agreement in your country, you may only use HorsePal with the permission and supervision of a parent or legal guardian.

By using HorsePal, you confirm that the information you provide when creating your account is accurate and that you are authorised to use the Service.

Certain features of HorsePal may require you to create an account.

You must notify us as soon as reasonably possible if you believe your account has been accessed without your permission.

You must not share your login credentials in a way that could compromise the security of your account or the Service.

HorsePal allows you to enter, store and manage information about your horse or horses.

You are responsible for the accuracy, completeness and currency of the information you enter into HorsePal.

HorsePal does not independently verify information entered by users, including veterinary records, vaccination dates, medication information, appointment information, health records, identification details or reminders.

You should always retain any important original veterinary, ownership, identification, insurance or other records where appropriate.

HorsePal should not be treated as the sole permanent storage location for critical information.

HorsePal is designed to assist with the organisation and management of horse-related information.

HorsePal does not provide veterinary advice.

Information available through HorsePal, including reminders, records, notes, schedules or other features, is provided for organisational and informational purposes only.

If you have concerns regarding the health, welfare or safety of a horse, you should contact a qualified veterinarian or appropriate equine professional.

In an emergency, you should contact a veterinarian or relevant emergency service directly and should not rely on HorsePal.

HorsePal may allow users to create reminders for matters such as vaccinations, veterinary appointments, farrier visits, dental care, treatments and other activities.

Reminders and notifications are provided as a convenience only.

We cannot guarantee that a notification will always be delivered at a particular time or at all.

You remain responsible for monitoring important dates, appointments, treatments and other obligations relating to your horse.

You should not rely exclusively on HorsePal notifications for time-sensitive veterinary care, medication, vaccinations or other important matters.

Certain HorsePal features may require a paid subscription.

Current subscription options and pricing will be displayed within HorsePal or through the relevant app marketplace before purchase.

Subscription fees may be charged through third-party platforms such as the Apple App Store, Google Play, or another authorised payment provider.

By purchasing a subscription, you authorise the applicable payment provider to charge the subscription fee in accordance with the subscription option you select.

Unless otherwise stated at the time of purchase, subscriptions may automatically renew until cancelled.

You are responsible for cancelling your subscription before the applicable renewal date if you do not wish for it to renew.

Cancellation and billing may be managed through the platform through which you purchased your subscription.

Deleting the HorsePal application does not necessarily cancel an active subscription.

HorsePal may offer free trials, introductory periods, discounts or other promotional offers from time to time.

The duration and conditions of any offer will be displayed when you sign up.

Where a free trial automatically converts into a paid subscription, this will be disclosed before you subscribe.

Unless you cancel before the end of the applicable trial period, your subscription may automatically convert to a paid subscription and the applicable subscription fee may be charged.

Promotional offers may be subject to eligibility requirements and may be changed or withdrawn where permitted by law.

HorsePal may change subscription pricing from time to time.

Where required, existing subscribers will receive appropriate notice of changes to their subscription price.

Any pricing change will be implemented in accordance with applicable law and the requirements of the platform through which the subscription was purchased.

You may cancel your HorsePal subscription through the platform or payment provider through which you subscribed.

Cancellation generally prevents future renewals but does not necessarily provide a refund for an existing subscription period.

Refund requests for purchases made through Apple or Google may be subject to the refund policies and processes of those platforms.

Nothing in these Terms limits any rights or remedies you may have under applicable consumer protection laws, including the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, where those laws apply.

You agree not to misuse HorsePal.

We may restrict or suspend access where we reasonably believe the Service is being misused or these Terms have been materially breached.

You may upload or enter content into HorsePal, including photographs, documents, notes, horse information and other records ("User Content").

You retain ownership of your User Content.

You grant HorsePal the limited rights necessary to host, store, process, display and otherwise handle your User Content for the purpose of providing, maintaining and improving the Service.

You are responsible for ensuring that you have the necessary rights or permissions to upload any User Content you submit to HorsePal.

We do not claim ownership of your horse records, photographs or other User Content merely because they are stored using HorsePal.

Your privacy is important to us.

Our collection, use, storage and handling of personal information is described in Part B - Privacy Policy below.

By using HorsePal, you acknowledge that your personal information will be handled in accordance with our Privacy Policy and applicable privacy laws.

Except for User Content, HorsePal and its associated intellectual property belong to HorsePal or its licensors.

Your use of HorsePal does not transfer ownership of any HorsePal intellectual property to you.

You may not copy, reproduce, distribute, sell, license or commercially exploit HorsePal's intellectual property without prior written permission, except where permitted by law.

HorsePal may interact with third-party services, including app stores, payment processors, analytics providers, cloud infrastructure providers and other technology services.

Those third-party services may have their own terms and privacy policies.

HorsePal is not responsible for third-party services to the extent permitted by applicable law.

We aim to provide a reliable Service, but we cannot guarantee that HorsePal will always be available, uninterrupted, secure or error-free.

We may modify, update or improve features of HorsePal over time.

We take reasonable steps to protect information stored through HorsePal.

However, no electronic storage system can guarantee that data will never be lost, corrupted, deleted or become temporarily unavailable.

You should retain copies of particularly important information where appropriate, including veterinary documents, ownership records, identification documents and other critical records.

To the maximum extent permitted by applicable law, HorsePal will not be liable for indirect, incidental, special or consequential loss arising from your use of or inability to use the Service.

Nothing in these Terms excludes, restricts or modifies any liability or consumer right that cannot lawfully be excluded, restricted or modified.

HorsePal is intended to make horse record keeping and management easier.

We do not guarantee that use of HorsePal will prevent missed appointments, health issues, veterinary emergencies, financial loss or other adverse outcomes.

Users remain responsible for the care, management and welfare of their horses and for seeking appropriate professional advice when necessary.

You may stop using HorsePal at any time.

Where appropriate and reasonably practicable, we may provide notice before terminating an account.

HorsePal may evolve over time.

We may add, modify, replace or discontinue features as we develop the Service.

Where a change materially affects a paid service or a user's legal rights, we will provide notice where required by applicable law.

We may update these Terms from time to time to reflect changes to HorsePal, our business practices, legal requirements or regulatory obligations.

The updated Terms will include a revised "Last Updated" date.

Where required by law, we will provide appropriate notice of material changes.

Your continued use of HorsePal following the effective date of updated Terms constitutes acceptance of those Terms where permitted by law.

If you are a consumer in New Zealand, you may have rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986, and other applicable New Zealand legislation.

Nothing in these Terms is intended to exclude or restrict rights that cannot legally be excluded or restricted.

These Terms are governed by the laws of New Zealand.

Subject to any rights you may have under applicable consumer law, disputes relating to these Terms or HorsePal will be subject to the jurisdiction of the courts of New Zealand.

If you download HorsePal through Apple's App Store, you acknowledge that these Terms are between you and HorsePal, and not Apple.

Apple is not responsible for HorsePal or its content, maintenance or support, except to the extent required under Apple's applicable terms.

Your use of HorsePal must also comply with applicable App Store terms and conditions.

If you download HorsePal through Google Play, your use of HorsePal may also be subject to applicable Google Play terms and policies.

Purchases, subscriptions, cancellations and refunds processed through Google Play may be subject to Google's applicable billing and refund procedures.

These Terms, together with the HorsePal Privacy Policy and any additional terms expressly presented to you when purchasing or using a particular feature, form the agreement between you and HorsePal regarding your use of the Service.

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

By creating an account or using HorsePal, you acknowledge that you have read, understood and agree to these Terms of Use.
